XVI BRAZILIAN CONGRESS OF INSURANCE AND PENSION LAW | RIO DE JANEIRO

Vanzin e Penteado, through its partners Juliana Mara and Mônica Rudolf, was present at the XVI Brazilian Congress of Insurance and Pensions, promoted by AIDA Brasil held on March 14th and 15th in RJ. The event featured an exhibition and debates on current topics relating to the insurance market.

The 1st panel of the XVI Brazilian Congress of Insurance and Pensions brought highlights of the proposed reform of the Civil Code, especially those impacting the insurance activity. There was the participation of important members of the Commission of Jurists responsible for the proposal to update the Civil Law, such as Prof. Dr. Flavio Tartuce, Prof. Dr. Angelica Carlini, and TJRS Judge Marco Aurelio Bezerra de Melo. The fact that it was the first reform proposal also produced by women was celebrated.

Afterwards, there was the launch of a thematic book that included articles written by Partner Juliana Mara and other professionals with outstanding experience in Insurance Law, followed by simultaneous debate meetings in the AIDA Working Groups, deepening studies such as the GNT Innovation and New Technologies, which discussed the Artificial Intelligence regulation bill.

The 2nd panel dealt with the repercussions of new technologies added to the supplementary healthcare system and necessary reflections, chaired by Dr. Milena Fratin. Dr. Fernanda Paes Leme, Professor and Coordinator at IBMEC, addressed sensitive issues affecting supplementary health and drawing parallels between population evolution, demographic, socioeconomic issues and other factors that impact and expose the population's low coverage by health plans and insurance in Brazil .

In the speech of Dr. Helton Freitas, President of Unimed Seguros, the repercussions of new technologies added to the public and supplementary health system and necessary reflections on the prior evaluation criteria for the incorporation of new technologies were highlighted, comparison between international criteria and the adopted in Brazil, as well as the impacts of the significant increase in assistance costs and the consequences for beneficiaries.

Dr. Hellen Miyamoto, Superintendent, of Fenasaude the relationships between the cost-effectiveness analysis of new treatments and implications for the sustainability of private and public systems, problematizing factors linked to the process of analysis and incorporation of technologies, partly organized based on demand from the interested pharmaceutical industry itself. It concludes by calling for the necessary debate on sharing risks and equal criteria between CONITEC and SUS in the incorporation of technologies, which must have an impact and therefore involve the whole of society.

On the second day, the 3rd Panel's theme was transport insurance, with the presence of Ricardo Alberto Pereira, Judge of the TJRJ, as well as Eliane M. Octaviano Martins, Director of MLAW and Dr. Darcio Mota. Issues relating to civil liability, compensation and the crisis in subrogation law are addressed, tracing the evolution of jurisprudence involving arbitration issues.

The 4th Panel addressed climate change, risks and impacts on society and insurance operations. Alfredo Chaia, Managing Director of Internacional Risk Veritas, addressed current climate phenomena such as droughts, intense rains, talking about the challenges, effects on business strategies, trends with the greatest impact on business transformation, risks emerging from this new environment and the role of insurance for mitigate the impacts of catastrophic events that have been increasing. He mentioned, in the context of the necessary resilience, the predictions of the National Risk Management, Alert and Response Plan, as well as the performance of risk management and impact mitigation bodies (CEMADEN, CENAD and SEDEC)

Dr. Caroline Mourão, meteorologist at Cemaden, illustrated in numbers the historical comparison of losses and deaths resulting from natural disasters between the 80s and 90s, in contrast to the numbers from the last two decades.

Sergio Franklin, from SUSEP, discussed the efforts to adapt the Insurance operation to changing climate scenarios, based on geospatial data and statistics, also mentioning the challenges and opportunities linked to parametric Insurance.

Afterwards, the GT's meetings took place, with relevant debates on various related topics, such as the effects of new technologies and new risks linked, for example, to hybrid vehicles, as well as implications for car insurance, home insurance and condominium insurance. .

Closing the Congress, the 5th panel 5 chaired by Dr. Juliano Ferrer, President of AINDA, included representatives from SUSEP and CNSEG, and debated about guarantee insurance and its role in economic development, and included the participation of Ana Paula de Almeida Santos, director of Sustainability and Consumer Relations at CNseg, as well as Carolina Jardim, director of Credit Specialty at Marsh Brasil. Relevant considerations on the evolution of the insurance market and the infrastructure sector, and even the issue of carbon credits, are discussed.
